Asbestos Mesothelioma

Hello, I am doing some research into negligence and asbestos related-illnesses , and was wondering whether a claimant (who is the son of a man who worked with asbestos over a period of 40 years) and now suffers from Mesothelioma, could claim compensation against his father’s employers? Would they be at fault? Also , does anyone know of any sources to back this up if he could claim – any recent law cases or appeals, or anything where the spouse or child of someone who has worked with asbestos and the victim suffered from an illness because of this and they have been successful in claiming against the company?
Any information , suggestions, opinions, advice etc would be welcome and truly appreciated!

So if the person that you are referring to was living at home while his father worked with asbestos then there seems to be a strong probability that this caused his illness because he could have breathed in some of the dust from his father when he came home from work, it seems that working with asbestos is the main cause of developing mesothelioma, having said that, I do not know how it could be proved that this was the cause, a court could argue that the man could just have easily breathed in the dust at other times in his life, there are loads of law companies out there that would give advice and take on the case if they think that they could win and they do it on a no win no fee basis, just type into your browser, claims for mesothelioma, you will find one easily.


There is no such thing as “Asbestos Cancer”. Mesothelioma is cancer of the mesothelium which occurs after exposure to asbestos. Cancer can occur anywhere in the mesothelium and most often occurs in the pleura of lungs.

How many mechanics have actually died of mesothelioma? I cannot find any statistics out there, but I think I have been exposed to an asbestos clutch fairly recently for a very brief period of time. Plus, my father worked as a part’s salesmen and probably handled some of the parts…. AND ALSO, I remember as a kid I used to wipe the black brake dust off of my father’s truck wheels onto my hand. Really stupid, I know, but I was just a kid. Everything that I have read about asbestos indicates that I will be fine, but there are some cases where I have heard of people getting mesothelioma from only brief exposures, which is troublesome to say the least. The thing I don’t get at all is why you need a hazmat suit to remove the stuff from homes but this stuff is still in automobile friction products? It’s ridiculous if you think about it. If you walk past a brake shop or a garage you could be exposing yourself to asbestos fibers. Even around busy highways. Or if you stand in line in a grocery store behind a mechanic with dirty overalls…. the same thing…. airborne asbestos. But, they will lock down a school if a piece of asbestos pipe breaks. I guess it’s something that no one talks about, but if asbestos exposure from brake pads and clutches were as serious as some people make them out to be then wouldn’t mechanics be dropping like flies? I have read of some mechanics who have gotten mesothelioma, but I have never read any statistical break down of mesothelioma by occupation. So, really, how serious is this for people who work on cars/change brake pads and clutches?

first of all none of these businesses use asbestos anymore, so your chances of exposure are 0 and the biggest problem was the dust. If you were working with the company that made and bonded the brake or clutch material, or like plumbers who used to grab handfuls of asbestos and mix with water and have asbestos snowball fights Unless you are exposed in a closed environment with the tiny dust particles you should be fine. If in the process of reconstruction asbestos is found, there are companies that are trained to come in and remove the asbestos insulation, they set up a filtering system that pulls a lot of air towards a filter, then wearing hazmat suits and masks will bag up the material and make sure none is left. I have a roommate who was a plumber for many years, who recently passed away, he had Asbestos Exposure (he was the one who told me about the asbestos ball fights . The reason this whole asbestos thing got so much exposure was that the companies selling this crap, knew long beforehand that asbestos was some bad stuff, and did nothing to try to stop it, or find alternatives, they just kept making millions and millions of dollars at the expense of thousands and thousands of hard working men and women .
Even when huge companies knew this stuff was wicked bad, they did nothing to stop it, that’s pretty pathetic, making money off the bones of people like you and me.
